Uninsured/Underinsured Motorist Claims

Uninsured/Underinsured Motorist are claims brought against an insurance company either because the alleged at-fault driver did not carry enough insurance in light of the liability exposure (underinsured) or where the alleged at-fault driver is uninsured. Those claims often involve an analysis of the policy language involved as well as application of the law governing third-party bodily injury claims which includes arguing that the plaintiff has not met the tort threshold.
