HUMAN RESOURCES- We prepare and update employee handbooks and policies, and consult employers about their current employment practices.  We consult on issues of Federal and State regulation of conditions of employment and employer operations, including the Family and Medical Leave Act, HIPAA, COBRA, Americans with Disabilities Act, Fair Labor Standards Act, ERISA and comparable Michigan law, Age Discrimination in Employment Act, Bullard-Plawicki Act and the Elliott Larson Act.  We are frequently called upon to help employers through internal problems such as discipline issues, work place violence, substance abuse, and wage and hour claims. 

EMPLOYEE LITIGATION - We represent employers in State and Federal Courts, as well as before administrative bodies such as the Michigan Civil Rights Commission and Equal Employment Opportunity Commission, defending against claims involving wrongful termination, sexual harassment, discrimination based on age, sex, marital status, race, and ethnic origin, defamation claims, invasion of privacy, interference with contractual relations and alleged violations of public policy. 

EMPLOYEE BENEFITS -

  • Qualified/Non-Qualified Retirement Programs - We counsel employers on pension, profit sharing, defined benefit, 401(k), employee stock ownership, and simplified employee pension plans, as well as non-qualified deferred compensation plans.
  • Health Benefits - Consultation occurs with employers on all aspects of employee health benefits, including benefit program design and innovations, self-insured and commercially insured plans, managed care, minimum premium arrangements, high deductible plans, flexible benefit plans, medical reimbursement and medical savings accounts, eligibility, discrimination, claims and taxation issues, contracts with related services, and constantly changing legislation.
  • Cafeteria Plans - We plan and prepare both simple and complex cafeteria plans including plan documents and employee communications, setting up and conducting non-discrimination testing, as well as review and repair of "canned" cafeteria plan products.  The firm is capable of providing the same kinds of services for employer funded medical reimbursement plans.
  • COBRA Management Systems - The firm works with employers designating COBRA management systems and working with individual COBRA problems such as those arising from failure to timely terminate COBRA coverage, errors in calculation of COBRA premiums, failure to give required notices, and the sequence of COBRA coverage with employer or union-sponsored extended benefits and conversion rights.
